Yip Tse & Tang advises on divorce and other divorce related matters in Hong Kong. These matters may include:
divorce considerations
children custody
maintenance to spouse and children
assets division
Very often, divorce proceedings are good to settle instead to argue. We encourage mediation through negotiations and settle the issues with the paramount welfare of children. When there are no children, division of assets may become a big issue as both sides may have accumulated large size of assets during matrimony with long success in careers and business. Each month we take more than 100 divorce cases and have them properly filed in the Family Court by our lawyers.
We are serious about the legal practice on divorce matters. Therefore, we have a website dedicated to this special need: www.twodivorce.com. Many have found the FAQ very helpful to them.
Asset division: The "fairness principle" in LKW v DD, Court of Final Appeal judgment
Family Law in Hong Kong follows closely that in the UK. Hong Kong’s Court of Final Appeal in LKW v DD
adopted the ‘equal sharing’ principle in the English landmark case of White v White. A ‘yardstick of equal division of property’ is to be applied after meeting the parties’ financial needs when the court exercises its discretion with surplus assets pursuant to section 7 of the Matrimonial Proceedings and Property Ordinance (Cap. 192) , unless considerations in that section call for a departure.
